General Terms & Conditions

This Agreement for General Terms & Conditions for using Netvaz Services (hereinafter the "Agreement" or "General Terms") has been entered into:

BY AND BETWEEN - Netvaz

Netvaz having its registered office situated at [Your Office Address], Pakistan, through its duly authorized officer (hereinafter "Netvaz") which expression shall include its successors-in-interest, permitted assigns and duly authorized officers.

AND - The Customer

An individual, entity or person, whether natural or juridical, whether incorporated or un-incorporated, who has agreed and accepted to access, avail or use any of the Services provided by Netvaz.

1. Definitions

1.1 "Agreement" or "AUP"Includes these General Terms, and any other specific terms, policies, notifications, directives, terms and conditions printed on invoices, circulars, user manuals, and instructions which Netvaz keeps amending from time to time.
1.2 "Applicable Laws"Any instrument having force of law such as enactments, statutes, Acts, ordinances, orders, rules, regulations, directives, circulars, SOPs etc., legislated under competent legislative power.
1.3 "Services"Shall include Internet Domains, Web Hosting, Virtual Private Servers (VPS), Shared Hosting, Reseller Hosting, Dedicated Servers, Colocation Services, Email Hosting, Cloud Services, SSL Certificates, and any other services provided by Netvaz.
1.4 "Shared Hosting"A web hosting service where multiple websites reside on a single web server connected to the Internet.
1.5 "VPS Hosting"Virtual Private Server hosting that partitions a physical server into multiple virtual servers, each with dedicated resources.
1.6 "Dedicated Server"A physical server entirely leased to a single customer with full root access and dedicated resources.
1.7 "Colocation"The service of housing customer-owned servers and networking equipment in Netvaz's data center facility.
1.8 "Domain Registration"The process of reserving a domain name for a specified period through accredited registrars.
1.9 "System"Includes every type of hardware(s), software(s), operating or application software, platform(s), servers, cloud, network, physical or non-physical storage devices or facilities, licenses, telecommunication systems.
1.10 "Data Center"Netvaz's facility housing servers, networking equipment, and infrastructure for service delivery.
1.11 "Bandwidth"The amount of data transfer allocated to Customer's services on a monthly basis.
1.12 "Uptime"The percentage of time services are accessible and operational, excluding scheduled maintenance.
1.13 "SLA"Service Level Agreement outlining performance commitments and credits for downtime.
1.14 "Paid Support"Premium technical support services available for an additional fee beyond standard support.

2. Services Overview

Netvaz provides a comprehensive range of hosting and internet services. The Customer acknowledges that:

  • Services are provided on an "as-is" and "as-available" basis
  • Netvaz does not guarantee 100% uninterrupted service due to maintenance, upgrades, or circumstances beyond control
  • Service levels may vary based on the specific service type selected
  • All services are subject to resource limitations as defined in the applicable service plan
Important: The Customer acknowledges that suspension, termination or deterioration in quality of Services shall not entitle him for any claim against Netvaz.

3. Web Hosting Services

3.1 Shared Hosting

Shared hosting accounts share server resources with other customers. The Customer agrees to:

  • Not use shared hosting for storage purposes exceeding 5GB of files (excluding website content)
  • Not exceed CPU, memory, or I/O limits that affect other customers
  • Not run background processes, cron jobs exceeding 15 minutes runtime
  • Not host file-sharing, torrent, or proxy websites
  • Comply with fair usage policy – excessive resource usage may result in suspension
3.2 Reseller Hosting

Reseller hosting allows Customers to sell hosting services to third parties. The Reseller agrees to:

  • Ensure all sub-customers comply with these Terms of Service
  • Be fully responsible for actions of all sub-customers
  • Maintain their own terms of service and privacy policy
  • Not oversell resources beyond allocated limits
  • Netvaz reserves the right to suspend accounts of sub-customers violating terms
3.3 Email Hosting

Email services are provided with the following limitations:

  • Maximum 500 outgoing emails per hour per domain (prevents spam)
  • Email storage limited to plan specifications
  • No bulk email marketing without prior approval
  • SPAM complaints may result in immediate account suspension
  • Netvaz reserves the right to block ports for security reasons
Backup Policy: Netvaz performs weekly backups of shared hosting accounts. However, Customers are strongly advised to maintain their own off-site backups. Backup restoration may incur fees.

4. Virtual Private Server (VPS) Hosting

4.1 VPS Specifications

VPS plans include dedicated resources as specified in the service plan:

  • Guaranteed CPU cores, RAM, and storage as per selected plan
  • Full root access via SSH (Linux) or Administrator access (Windows)
  • Choice of operating system (subject to availability)
  • Dedicated IPv4 address included
  • Bandwidth limits as specified – overage fees apply at prevailing rates
4.2 Customer Responsibilities

VPS customers have greater control and therefore greater responsibility:

  • Complete responsibility for server security, updates, and patches
  • Monitoring server resources and performance
  • Maintaining regular backups of all data
  • Compliance with all applicable laws regarding server content
  • No illegal activities including cryptocurrency mining without explicit approval
4.3 Managed vs Unmanaged VPS
Managed VPS:
  • OS updates and security patches
  • Basic server monitoring
  • Control panel management (cPanel/Plesk)
  • Limited application support
Unmanaged VPS:
  • Self-managed – Customer handles all administration
  • Root access only – no OS management by Netvaz
  • Hardware and network support only
  • Lower cost with higher responsibility
VPS Restrictions: The following are strictly prohibited on VPS services: open mail relays, public proxies, cryptocurrency mining, DDoS attacks, port scanning, and any activity that violates network policies.

5. Dedicated Servers

5.1 Server Specifications

Dedicated servers provide exclusive use of physical hardware:

  • Dedicated CPU, RAM, storage, and bandwidth as specified
  • Full root/administrator access
  • Choice of hardware configuration (subject to availability)
  • Dedicated IPv4 address allocation (additional IPs available for purchase)
  • 99.9% power and network uptime SLA
5.2 Server Management Options
Self-Managed: Customer handles all server administration, security, and software.
Semi-Managed: Netvaz handles OS updates and basic security; Customer manages applications.
Fully Managed: Netvaz handles all server administration, security, monitoring, and support.
5.3 Hardware Replacement

Netvaz guarantees hardware functionality. In case of hardware failure:

  • Netvaz will replace failed hardware within 4 hours during business hours
  • Data recovery is Customer's responsibility – regular backups required
  • Raid configurations available for data redundancy at additional cost
SLA Commitment: Dedicated servers include 99.9% network uptime SLA. Credits may be issued for qualifying downtime as per the Service Level Agreement.

6. Colocation Services

6.1 Service Description

Netvaz provides secure data center space for Customer-owned equipment. Colocation includes:

  • Rack space (full rack, half rack, or cabinet) with power and cooling
  • Redundant power supply with UPS and generator backup
  • Climate-controlled environment (temperature and humidity regulated)
  • 24/7 physical security with biometric access control
  • Bandwidth options from 1Gbps to 10Gbps
6.2 Customer Responsibilities
  • Providing, maintaining, and supporting all colocated equipment
  • Ensuring equipment meets data center safety standards
  • Scheduling remote hands requests 24 hours in advance
  • Compliance with data center access policies
  • Insurance coverage for colocated equipment
6.3 Remote Hands Services

Netvaz offers remote hands services for colocation customers (additional fees apply):

  • Basic remote hands: $50/hour (rebooting, basic troubleshooting)
  • Advanced remote hands: $100/hour (cabling, hardware replacement)
  • After-hours support: 1.5x standard rates
6.4 Power and Bandwidth
  • Power is billed per amp (A) consumed – 208V standard, 120V available
  • Bandwidth billed on 95th percentile billing or flat rate as per agreement
  • Overage charges apply for exceeding committed bandwidth
Hardware Warranty: Netvaz does not warrant Customer-owned equipment. Customers are responsible for hardware warranties and maintenance.

7. Domain Name Services

7.1 Domain Registration

Netvaz acts as a reseller for domain registrations through accredited registrars:

  • Domain availability is not guaranteed until registration is confirmed
  • Registration is final and non-refundable once processed
  • WHOIS information is publicly accessible per ICANN requirements
  • Customers must provide accurate and complete WHOIS information
7.2 Domain Renewal
  • Renewal notices sent 30, 15, and 7 days before expiration
  • It is Customer's sole responsibility to renew domains before expiration
  • Expired domains may incur redemption fees (up to $150) after grace period
  • Domains may be released to the public after expiration
7.3 Domain Transfer
  • Transfer requires domain to be unlocked and EPP code obtained
  • Domain must be registered for at least 60 days to transfer
  • Transfers take 5-7 days to complete
  • Transfer fees are non-refundable
Important: Domain registrations and renewals are non-refundable. Redemption fees apply for domains recovered after expiration grace period.

8. Support Services

8.1 Standard Support (Included)

All active accounts receive standard support covering:

  • 24/7 basic technical support via ticket system
  • Control panel assistance
  • DNS and email configuration
  • Basic troubleshooting
  • Response time: 2-4 hours during business hours, 6-12 hours after hours
8.2 Premium Paid Support

For Customers requiring enhanced support, Netvaz offers premium support packages:

  • Monthly health check
Enterprise Support - $149/month
  • 5-minute response time
  • Dedicated account manager
  • 24/7 phone support
  • Weekly health reports
  • Server optimization
Developer Support - $99/hour
  • Code-level debugging
  • Custom script development
  • Performance optimization
  • Security auditing
8.3 Scope of Support

Support does NOT include:

  • Third-party software development or debugging
  • Custom scripting or application development
  • Content creation or website design
  • SEO services
  • Migration from non-cPanel environments (additional fees apply)

9. Billing, Payments, and Refunds

9.1 Billing Cycle
  • Services are billed monthly, quarterly, annually, or as selected
  • Invoices are generated 14 days before due date
  • Payment due date is the first day of the service period
  • Late payments subject to 10% late fee per month on overdue balance
9.2 Accepted Payment Methods
  • Credit/Debit Cards (Visa, Mastercard, American Express)

  • Bank Transfer/Wire Transfer
  • Cryptocurrency (USDT, Bitcoin) – 2% processing fee

9.4 Service Suspension and Termination
  • Services suspended after 7 days past due
  • Termination after 30 days past due with loss of data
  • Reactivation fees: $25 for shared hosting, $50 for VPS, $100 for dedicated servers
  • Data recovery after termination: $100/hour (no guarantee)
Chargebacks: Any chargeback or payment dispute will result in immediate suspension and a $50 administrative fee.

10. Acceptable Use Policy

10.1 Prohibited Content

The following content is strictly prohibited on any Netvaz service:

  • Child pornography, exploitation, or abuse material
  • Terrorism, extremist, or hate group content
  • Copyright infringing material (torrents, warez, pirated software)
  • Phishing, fraud, or identity theft schemes
  • Malware, viruses, trojans, or malicious code distribution
  • Illegal drug or paraphernalia sales
  • Weapons, firearms, or ammunition sales without license
  • Gambling or casino sites without license
  • Proxy or anonymizer services
  • Open mail relays or SMTP servers without authentication
10.2 Prohibited Activities
  • Port scanning, network probing, or vulnerability testing without authorization
  • DDoS attacks, DoS attacks, or network flooding
  • Spam, unsolicited bulk email (UBE), or email harvesting
  • Crypto mining (CPU/GPU mining) without written approval
  • BitTorrent or P2P file sharing
  • TOR nodes or exit relays
  • IRC servers or bots
  • DNS amplification attacks
  • Password cracking or brute force attacks

10.4 Email and Spam Policy
  • Maximum 500 emails per hour per domain on shared hosting
  • Double opt-in required for marketing lists
  • Valid unsubscribe link required in all marketing emails
  • No purchased or rented email lists permitted
  • SPAM complaints result in immediate account review and possible suspension

11. Security and Data Protection

11.1 Customer Security Responsibilities
  • Maintain strong passwords and change regularly
  • Enable two-factor authentication where available
  • Keep all installed software updated with security patches
  • Regularly scan for malware and vulnerabilities
  • Maintain off-site backups of all critical data
  • Immediately report any security incidents to Netvaz
11.2 Netvaz Security Measures
  • 24/7 network monitoring and intrusion detection
  • DDoS protection up to specified limits per plan
  • Firewalls and access controls
  • Regular security audits and updates
  • Physical security at data centers (biometric access, 24/7 surveillance)
11.3 Data Backup
Important: Customers are solely responsible for maintaining their own backups. Netvaz provides backup services as a convenience only and does not guarantee data restoration. Backup services may be purchased separately for VPS and dedicated servers.

12. Force Majeure

Netvaz shall not be liable for failure or delay in performance due to circumstances beyond reasonable control including:

  • Acts of God, natural disasters, earthquakes, floods, fires, pandemics
  • War, terrorism, civil unrest, riots, strikes, lockouts
  • Government actions, regulations, or embargoes
  • Power outages, utility failures, or telecommunications failures
  • Cyber-attacks, DDoS attacks, or network intrusions
  • Hardware failures not caused by Netvaz negligence
  • Third-party service provider failures

If force majeure conditions continue for more than thirty (30) days, either party may terminate this Agreement without liability.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Netvaz's total liability shall not exceed the amount paid by Customer in the 3 months preceding the claim
  • Netvaz shall not be liable for indirect, incidental, special, consequential, or punitive damages
  • Netvaz shall not be liable for loss of profits, revenue, data, or business opportunities
  • Netvaz shall not be liable for any damages arising from service interruptions, data loss, or security breaches
  • Customers are responsible for insuring against potential losses
No Warranty: SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

14. Termination

14.1 By Customer
  • 30-day written notice required for termination
  • Services continue until end of billing cycle
  • No refunds for unused prepaid periods
  • Data must be backed up before termination
14.2 By Netvaz

Netvaz may terminate immediately without notice for:

  • Violation of Acceptable Use Policy
  • Non-payment or repeated late payments
  • Fraudulent or illegal activity
  • Actions that threaten Netvaz's network or other customers
  • Bankruptcy or insolvency of Customer

15. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Your City], Pakistan.

Prior to litigation, both parties agree to attempt good faith mediation to resolve disputes.

16. Amendments

Netvaz reserves the right to amend these Terms of Service at any time. Amendments become effective upon posting to the Netvaz website. Continued use of services constitutes acceptance of amended terms. Material changes will be notified via email at least 30 days in advance.

By using Netvaz services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
